In SR International Business Insurance Co., Ltd. v. World Trade Center Properties, LLC, the U.S. Court of Appeals for the Second Circuit addressed an issue which it previously acknowledged had been unsettled: in determining the meaning of ambiguous contract language, what consideration, if any, may be given to a party's uncommunicated subjective intent, what the party intended but did not express to the other party.
